The Department is responsible for two inter-related functions of the City; the planning and development function and the building code permitting and enforcement function. The planning function entails the formulation and implementation of the City's Comprehensive Plan and Development Code, which includes zoning and subdivision management regulations. Additionally, the Department overseas the implementation and enforcement of the City's flood plane management ordinance and building codes. The Department is also responsible for working with appointed boards, including the Planning Commission, Zoning Board of Appeals, Economic Development Commission and other special committees. We work with these appointed bodies through the preparation of research materials and application processing prior to their review by the appropriate board, commission or committee. The other function of the Department involves building inspections and code enforcement. The Department reviews architectural building plan designs for compliance with the adopted building and associated codes and conducts inspections of new construction and existing residential units for compliance with relevant codes. OCCUPANCY PERMITS: The City requires the inspection of all dwelling units each time there is a change of occupancy, whether the dwelling is owner-occupied or rented. The City inspection is a limited, visual inspection of the home to determine that the minimum Code requirements are met. This inspection is NOT intended to replace the "whole house inspection" that is frequently recommended by your realtor and which is far more detailed than the City's inspection. Once the dwelling has successfully passed the City housing inspection, the tenant is required to secure an Occupancy Permit. You may schedule your inspection by calling the Land Use and Development Department at (618) 489-2060. The schedule for housing inspections fills up very quickly during the summer months while residents are relocating and it is recommended that you make your appointments early.
LEAF BURNING: Burning of vegetation grown specifically on the property is permitted by Ordinance on Tuesdays, Thursdays and Saturdays, from 9 a.m. to 4 p.m. from November 1st through April 30th of each year. Fires must be attended at all times, extinguished by or at 4 p.m., contain NO construction material, paper or trash, be confined to private property (not in rights-of-way, not on paved surfaces, not in drainageways and not in gutters). A substantial fine may be levied for violations.
RV PARKING: Recreational vehicle parking is prohibited on the street or front driveway of any residential property. The Ordinance provides that all boats, trailers, campers and other recreational or sports vehicles must be stored along the side of or to the rear of the residence on an aggregate base, i.e., a stone or concrete pad or driveway which will adequately support the vehicle's weight. FENCES & SHEDS: Though no permit is required for fencing, there are some rules that do apply. Please check with our office BEFORE installing your fence. SHEDS: A permit may be required, depending on the size of the shed. Proper placement on your property is a MUST. Please check with our office BEFORE purchasing your shed. RIGHTS OF WAY: No new brick or stone mailboxes and no basketball hoops or hockey goals may be placed in the City right-of-way. Accessory Structures: A permit is required for installation of your accessory structure; i.e., storage buildings of 120 square feet or more, swimming pools of more than 24" in depth and detached garages. Proper placement on your property is a MUST. To avoid undue expense and inconvenience, please check with our office. Construction Inspections: All electrical, plumbing, construction and housing inspections can be scheduled by calling the Land Use and Development Department, with a minimum of 24 hours notice required.
618-489-2080 (Code Enforcement) 618-489-2084 (Animal Control) Code Enforcement involves addressing situations regarding property which are determined to be public nuisances as defined in the City's Revised Code. This would include, but is not limited to, the following at any location within the city:
618-489-2080 (Information) Anyone holding a yard sale, garage sale or similar sale on residential property in the City of Fairview Heights is reminded that there is an ordinance requiring a permit for such activities and also that the city provides for the temporary usage of two signs to help with the promotion of these sales. There is no fee for the yard sale permit or the use of the signs which are to be placed away from the premises where the sale is taking place. The signs, which come with a metal frame for sticking them into the ground, are made of a white styrofoam type of material and contain the words “Yard Sale” in large blue letters with a directional arrow underneath. Each sign given for a yard sale by the city also comes with a “topper” made of similar material upon which the address of the sale can be written. No more than two signs will be provided for each sale and they must be returned to the city hall during the next four working days after the sale is over. These city-provided signs are the only types of signs allowed off the property of the sale. Homemade signs, generally made out of some type of cardboard, are only allowed on the property where the sale is held. All off-premises homemade yard sale signs put up in the city will be removed as permitted by ordinance by code enforcement personnel. The signs from the city may be placed upon any public right-of-way on the day or days of the sale. Public right-of-way is generally that area between the street or roadway pavement surface and where utility poles are placed along the roadside. The ordinance covering such activities also includes tailgate sales, moving sales, or any type of sale of a similar nature at a residence. Businesses are covered by a separate and different set of regulations.
